High Penalties for Provoked. Protection for The Provocative

According to Polish judges, those provoked to act should be punished, and those who provoke should be protected. This absurdity is Polish reality. Unable to understand the logic of Polish law, I often direct my inquiry to the relevant ministry in the Polish authorities. Such a unit is the office of the Minister of Justice headed by Zbigniew Ziobro. In response, Ziobro’s office gives the same justifying formula that the Ministry of Justice has no influence on the decision of the courts. It is similar when I ask the same about the Supreme Court. The latter responds in the same way by emphasizing the independence of the judiciary. The simple conclusion can be drawn from this that the courts are independent and that no one has the right to question their decisions. It would be good if Polish courts were guided by a fair judgment and not the interest of exploiting the weaknesses of their victims.

Looking at the work of Polish courts, I see a mafia in them and I am writing this with full awareness. The arrogance of Polish judges with unlimited power is so great that judges no longer hide their decisions contrary to the logic, but are rather proud of them. Probably the master of this art is the court clerk Monika Maciejewska Banasiak from the district court in Lodz and, as we know, she is not the only one in this institution. On a national scale, it looks terrifyingly incompetent and raises doubts where do such judges come from? And can’t we do it better ourselves?

In Poland, no man has a chance of a fair judgment in court if he does not have a private lawyer. An advocate for a judge acts as a controller of his work, but the scale of this control depends on the wealth of the court victim. Nobody will help poor citizens, i.e. those most willingly raped. Theoretically, you can get an ex officio lawyer in Poland, this is the law, but the court decides about it, which does everything to prevent this from happening. In this case, even the Minister of Justice maintains a safe silence, ignoring this legal status and considering it to be appropriate.

Judges’ bias comes from their convictions and their will to end a case as soon as possible, not from a logical analysis. Oddly enough, these beliefs of all judges and lay judges in Poland are similar. An example is the exclusion, in the assessment of the situation, of a factor that provokes breaking the regulations, even if it is supported by evidence. This is a shock to me. The processes come down to an as soon as possible ending with the rejection of appeal applications together with a note on the non-contradiction of such a decision.

The Polish legal system is absolutely frivolous and works to the detriment of society. This is precisely because no one controls Polish judges. Nobody is watching Polish judges. There is no one to complain to so that they are not ignored. Poles cannot fight for their own cause and justice in courts outside their own country, and at the same time they are slaves of the impaired legal system in Poland. This gives lasting security to the judicial mafia in Poland. (Brux)
