The contract should be a legal guarantee document, but in Poland the employment contract does not guarantee compensation, that you will be paid. It is enough that the employer disappears and the employee himself is to blame for the lack of reward for his own naivety. This is the view of the Polish State Inspector of Labor (PIP), who in the case of reports of violations of labor rights in the field of non-payment, ask to address a complaint to regional inspectorates, and those after a failed attempt to contact the employed close the case leaving the deceived without support and suggesting that he himself is to blame. There are no enforcement improvements against the fraudster’s employer in Poland.
This is very important warning for foreigners who are not aware of the threats naively take up for in Polish small companies. Poles are also victims of this crime. I have tried to obtain information from the Chief Inspector of Labor (the highest quality of the working rights) about the scale of such disappearances of employers, but the office did not respond in accordance with the Polish administrative custom of ignoring uncomfortable questions and limiting the flow of sensitive information to media unfriendly for government.
This approach of the office and Polish law promotes crime. During the summer season, fraudsters conduction service companies mainly in the construction industry, functioning as seasonal companies, try to save on non-payment of wages.
Job seekers does not have access to any system for verifying the credibility of employers, except for opinions published on the Internet from other employees. The authorities are not interested in preventive action.
There are also cases where the employer does not pay wages and does not disappear when he is bankrupt. Here, too under Polish law, there is no chance of getting your salary back. Priority is given to the satisfaction of debtors by institutional creditors, i.e. offices, later companies. The employees are at the very end and usually already for them already need money from the auctioned estate.
The appalling provision is that the injured person who referred the case for official inspection and left the troublesome company moving to another, does not have insight into the result of the inspection control, because he is no longer an employee of the controlled company. Poles love such legal absurdities.
The facts are hiding that in Poland a large percentage of employees, maybe 30% once in a lifetime, have been cheated during pay and never obtained it in accordance with the terms of the contract. And half of it was dismissed from the office supervising labor rights as unsolved cases. The State Labor Inspectorate employs over 2.000 employees and has a supervisory board of 30 people. These positions are filled by the Prime Minister from among the members of the parliament. The salaries of government officials in Poland are confidential. (Brux)
